1. General
1.1 The Cancellation Protection is valid for the Icelandair tickets as listed on your invoice.
1.2 The Cancellation Protection covers the cancellation of Icelandair tickets paid for any prepaid travel extras, including extra baggage, seats, pre-order meals and other flight related travel extras (excluding cancellation protections) provided by Icelandair applicable for the duration of the ticketed itinerary. It does not cover any other travel related cost, such as accommodation, car rental, or activities booked.
1.3 Documentation in the form of a Medical Certificate signed by a doctor will be required specifying the nature of your illness or accident for the relevant travel date(s). Possession of a medical certificate does not qualify for reimbursement of flight tickets unless Cancellation Protection was purchased in advance.
Valid Medical Certificates to confirm a sudden illness or accident must be issued by a qualified medical professional for you, your partner, or others in your immediate family (see definition in 2.1. a) and meet the further conditions listed below;
1.3.1 Is from a valid medical center (including an authorized stamp/letterhead/signature)
1.3.2 Must specify the reason for canceling is directly a result of a sudden serious illness or accident
1.3.3 Must specify the period for which no travel is to be undertaken and those dates must coincide with the dates shown in the tickets.
1.3.4 Must be dated after the booking purchase date.
1.4 Icelandair Cancellation Protection is not insurance but a paid extra service for a flight ticket. Icelandair Cancellation Protection is not governed by insurance laws and regulations.
1.5 References to 'you' or 'yours' means the passenger who purchased the ticket and the Cancellation Protection.
1.6 Definition of immediate family: - your partner/spouse, registered partner, whether in the case of a partner by marriage or by established cohabitation, children or stepchildren, grandchildren, parents or parents-in-law, siblings, and grandparents
2. Repayment
2.1 Payment for the Cancellation Protection provides cover for the cost of your ticket and associated travel extras (as mentioned in paragraph 1.2) in case you are unable to travel due to:
a) death, sudden illness, or accident supported by a Medical Certificate (as mentioned in paragraph 1.3) where you or any other traveler in the same booking are advised against traveling because of sudden illness or accident, or the death of someone in your immediate family (as defined in term 1.6)
b) significant material damage to your home or at a private company, of which you are the majority owner, which renders your presence necessary (a police report should be available).
c) You contracting COVID-19 (or other illness classified by the WHO as a global pandemic) either before or during your trip which prevents you from starting or continuing your journey and can be proven by a documented medically approved test showing a positive result.
c. 1) The document needs to be issued by an organization licensed to issue such documents/medical laboratory/or signed by a registered medical doctor. No Home tests are accepted
c. 2) The test result must show positive for COVID-19
c. 3) The positive result must be recorded within 10 days of the scheduled departure date. If you are still unable to travel 10 days post a positive result, due to ongoing symptoms, a doctor's certificate meeting the conditions above must be provided
c. 4) Repayment does not apply to passengers in quarantine without a confirmed positive test result documented as per c.1), c.2), c.3) above
2.2 The nature of the circumstances listed above should be such that it is unavoidable to cancel a previously made travel booking.
3. Validity conditions
3.1 It is a condition for the right to repayment to be established that:
a) Cancellation Protection has been purchased;
b) you are not aware of the damage, loss, or incapacity nor have a suspicion of impending damage, loss, or incapacity, which establishes a right to repayment at or before the time when the Cancellation Protection charge is paid.
4. Excluded risks
4.1 A right to repayment is not established in the following instances of damage, loss, or incapacity.
a) incapacity which comes about as a result of deliberate self-inflicted injuries;
b) incapacity which comes about as a result of sickness which may be related to the use of alcoholic drinks or drugs, other than drugs that are taken under medical advice, except drugs used in medical treatment arising from the use of addictive and illegal drugs;
c) incapacity, loss, or damage as a direct or indirect result of nuclear reactions, ionizing radiation, contamination by radioactive substances, nuclear fuel, and nuclear waste materials, or as a result of war, military invasion operations, civil unrest, uprising, riot, or similar actions. The same applies to incapacity, loss, or damage arising directly or indirectly as a result of earthquakes, volcanic eruptions, floods, avalanches, or other natural disasters;
d) damage or loss arising from the cancellation or delay of scheduled means of transport;
e) incapacity, loss, or damage which comes about as a result of illness which you were suffering before or at the time when the Cancellation Protection charge was paid, or of your treatment for any such illness: see 3.1.b above;
e. 1)If you provide fraudulent or untrue descriptions or information or conceal events or circumstances, which are pertinent to Icelandair’s obligation for repayment, you will forgo your right to any repayment compensation due under the Cancellation Protection you purchased.
5. Procedures in the case of claims - repayment
5.1 In case of loss a claim shall be notified immediately and a medical certificate as specified in paragraph 1.3 above must be provided with (if applicable) an official confirmation of the need for medical treatment or a police report detailing the material loss or damage to your home or at your private company, supplied together with the receipt for airline ticket.
5.2 Repayment shall be made within 45 days of receipt of full and satisfactory proofs of Icelandair’s obligation for repayment in accordance with these terms and conditions and from the time when it is possible to determine the amount of repayment. The provision of certificates and other documentation supporting your claim of loss, which Icelandair may require in order to be able to assess its obligation for repayment will be at your own expense.
5.3 If you also have a right to compensation from insurance or other indemnification for the same cause of loss, Icelandair will only pay its proportion of any compensation.
6. Fraud - erroneous information
If you provide fraudulent or untrue descriptions or information or conceal events or circumstances, which are pertinent to Icelandair’s obligation for repayment, you will forgo your right to any repayment compensation due under the Cancellation Protection you purchased.
7. Address and registered office
Address & Registered Office: The address and registered office of Icelandair is at Reyjavik Airport, 102 Reykjavik, Iceland. Any disputes, that may arise regarding repayment in accordance with these terms and conditions, shall be taken to the District Court of Reykjavik.
